Pool Barrier Inspection / Pool Compliance Certificate

A pool barrier certificate is now required if selling or renting a property in NSW that has a swimming pool. There is a legal requirement for pool fences to comply with building codes and fines or enforcement orders can be issued by local council.

State and local government have set up a ‘Swimming Pool Register’ where all pools must be registered, along with the pool barrier compliance status.

An E1 pool inspector is required to insect the barrier and provide: either a “Certificate of compliance” or a “Certificate of Non-Compliance” in accordance with the legislation that applies to that particular pool. The findings from the inspection are logged on the Pool Register.

The owner is then obliged to make the recommended upgrades where necessary.

The vast majority of pool fences in NSW do not comply with current requirements and upgrading to the code can require significant expense. Common problem areas include landscaping and boundary fencing where modification of landscaping can be costly.
